How to Rent an Apartment in Israel Without a Broker
Renting directly from an owner is realistic, and the law helps the tenant on one key point: where a broker acted for the landlord, the tenant cannot be made to pay the fee. Below is the sequence from search to keys. This is general information, not advice. Bait·Direct does not verify owners or listings for you: the checks in this guide are yours to do.
Where to look for a place without intermediaries
Direct listings from owners appear on classifieds boards, in themed groups and on platforms where owners post themselves. One option is the Bait·Direct catalog, where owners publish their own listings. A listing on any platform does not mean anyone has checked the person or the apartment.
How to tell an owner from an intermediary:
- ask directly: "Are you the owner? Are you writing in your own name?";
- if a third party replies, ask who they work for and whether they charge a fee;
- keep the correspondence: it helps if a dispute arises.
Before a viewing, ask for the exact address, floor, number of rooms, rent, lease term and what is included in the price. Gaps between the listing and the site are a reason for caution.
How to check the owner: ID and Tabu extract
Before signing, make sure the person signing the lease is entitled to let the apartment.
- ID. Ask to see the identity card (teudat zehut) and compare the full name and number with the contract.
- Tabu extract (נסח טאבו). This is an extract from the land registry. Compare the owner's name with the ID and the address with the one in the contract. Note whether there are several owners and whether liens are recorded.
- Power of attorney. If someone else acts on the owner's behalf, ask for a notarized power of attorney (ייפוי כוח).
If the owner refuses to show documents, that is a serious reason not to sign. For complex cases, show the documents to a lawyer.
What to check at the viewing
Go in daylight, bring a phone for photos and video, and work through a list.
- Water and plumbing: pressure, drainage, signs of leaks, damp and mold.
- Electricity: sockets, the panel, lighting.
- Water heater, windows, doors: do they close and lock.
- Appliances and furniture: exactly what stays and in what condition.
- Air conditioning, parking, storage: anything promised orally should appear in the contract.
Under the law (section 25ב), before signing the landlord must disclose non-minor defects known to them in the apartment, and anything known to them in the apartment or its surroundings that causes or is likely to cause material disruption to its use. Ask about this out loud and write down the answer.
If possible, talk to neighbors: they can tell you things about the building that a listing does not.
How to negotiate and what to agree on
The law does not cap rent: it is set by the market and by agreement. Haggling is therefore normal. We do not quote "average prices": compare several similar listings in your area yourself.
What to discuss besides the amount:
- the lease term and a renewal option (אופציה) with pre-agreed rent: without one, renewal may bring a significant increase;
- linkage to the consumer price index (הצמדה למדד): whether it exists and from which month it is counted; the index can fall as well as rise;
- who pays the building committee fee (va'ad bayit) and what it covers;
- what the landlord will fix or replace before move-in: put it in the contract;
- how early exit works.
As a general rule, during the lease term the landlord may not raise rent unless the contract expressly allows it. Ask for anything agreed verbally in writing.
The written contract, deposit and guarantees
The law assumes a residential lease is made in writing, signed by both parties, with each receiving a signed copy (section 25ב). An oral lease is not automatically void, but it protects poorly and is hard to prove. Do not agree to a place without a written contract.
Check the contract for: names and ID numbers of both parties, address, description of the apartment, term, amount and date of payments, type and amount of security, return conditions, termination terms, and who pays arnona, building committee fees and utilities.
Deposit and guarantees
The total of all security may not exceed the lower of two figures: rent for 3 months, or rent for one third of the lease term. The cap applies where the tenant has to pay something for the security (for example a bank fee for a guarantee, or a cash deposit); ask a lawyer how it applies to other kinds of security. For a 12-month lease that is 3 months; for a 6-month lease it is 2 months. The landlord must return the security within 60 days of your vacating the apartment or settling your debts, whichever is later.
- Ask for a signed receipt (קבלה) for every payment and for the deposit.
- A bank guarantee is considered lower-risk for a tenant than a promissory note (שטר חוב), which can be enforced through the Execution Office without a full court hearing. Do not sign a שטר חוב without legal advice.
These rules (like the rest of the residential-rental chapter) do not always apply. They do not apply, for example, to rent above 20,000 NIS per month, to very long or very short leases (over 10 years or under 3 months, with nuances), to rentals between close relatives, to hotels and holiday lets, to assisted-living housing and to dormitories (section 25טו). Check current values on gov.il.
Utilities, arnona, building fees and the handover protocol
Moving accounts to your name. Where possible, put electricity, water and arnona (municipal tax) in your own name so you are not answerable for earlier debts. Arnona is usually paid by the tenant unless the contract says otherwise; check the classification and amount with your municipality. Ask neighbors and the landlord what the building committee fee is and what it covers. Transfer procedures differ between providers: ask them directly.
Handover protocol. On the day you get the keys, draw up a written apartment condition report with the landlord (פרוטוקול מצב דירה), attach it to the contract and have both sign it. Include:
- the condition of walls, floors, windows, plumbing and appliances;
- meter readings;
- a list of furniture and equipment;
- the number of keys.
Take dated photos and video of the whole apartment and send them to the landlord by email or messenger. That is your evidence if the landlord claims damage when returning the deposit. Reasonable wear from normal use is not damage.
Repairs. The landlord must fix a non-minor defect within 30 days of your request, and an urgent defect within 3 days. If the deadline passes, you may arrange the repair yourself and claim reasonable costs back from the landlord (give notice in advance and keep receipts) or, while the defect remains, reduce the rent in proportion; confirm the procedure with a lawyer. Minor day-to-day repairs and defects caused by your improper use are yours.
Broker's fee under the law
Where a broker acted on the landlord's behalf, the tenant cannot be required to pay the fee (section 25ט of the Rental and Borrowing Law). The landlord and tenant also cannot agree in the contract that the tenant will pay the landlord's share. Such a clause is void.
In practice:
- before a viewing, ask who brought in the broker and on whose behalf they act;
- read contract clauses about "commission" and "intermediary services" carefully;
- do not pay "for showing" or "for reserving" without written terms;
- if you hired a broker yourself, your relationship with them is governed by your own agreement; in complex cases consult a lawyer.
Renting directly from an owner removes the question: there is no intermediary and nobody to pay.
Important caveats
- This is general information, not legal or tax advice. For your own situation, consult a lawyer or accountant.
- Amounts, thresholds and the rules themselves can change: check current values (for example the small claims court limit) and the text of the law in force on gov.il and kolzchut.org.il.
- Bait·Direct does not verify owners, listings or documents; the checks are yours.
- See the lease contract page for a sample and reference material; owners who want to publish a listing can use the list a property page.
If anything in the contract looks odd, do not sign the same day: ask for time and show the text to a lawyer.
FAQ
Must I pay a broker if the landlord engaged one?
If the broker acted for the landlord, the tenant cannot be required to pay the fee, and a contract clause putting it on the tenant is void (section 25ט). In complex cases consult a lawyer.
What is the maximum deposit allowed?
The lower of rent for 3 months or rent for one third of the lease term. The cap applies where the tenant has to pay something for the security (for example a bank fee for a guarantee, or a cash deposit); ask a lawyer how it applies to other kinds of security. For 12 months that is 3 months. The rule does not always apply: for example, it does not apply to rent above 20,000 NIS per month. Check current values on gov.il.
Can I rent without a written contract?
The law assumes a written form signed by both parties (section 25ב). An oral lease is not automatically void, but protection is weak and terms are hard to prove. It is better to insist on a written contract.
What is a Tabu extract and why do I need it?
It is an extract from the land registry (נסח טאבו). You use it to compare the owner's name with their ID and the address with the contract, and to see recorded liens.
